On August 25, 2023, the European Commission announced that the Digital Services Act (DSA) has entered into force for 29 large online platform and search engines.
The purpose of the DSA is to promote safe environment for users using online services by establishing regulation for content moderation and setting a new standard for accountability of online platforms regarding illegal and harmful content.
Currently the DSA provisions apply only on the large platforms with at least 19 million users, and they will be subject to restrictions concerning advertising for example:
- banning targeted advertising of minors based on profiling; and
- banning targeted advertising using special categories of personal data, such as sexual orientation or religion.
In the near future we believe the DSA shall be applied to smaller online platforms and services and will be relevant to all online players.
It is a good time to start preparing.
