Omer represents and counsels companies and Hi Tech entrepreneurs on all types of Intellectual Property Rights (patents, trademarks, copyright, designs, know-how, trade secrets etc.), and counsels on Intellectual Property Protection Strategy and commercialization.
He assists companies and inventors in obtaining patent protection for their inventions, and counsels on the proper and most efficient form of protection available. He further counsels companies on how to avoid exposure of intellectual property infringement, and assists with freedom to operate analysis and co-existence agreements.
Omer is an experienced IP litigator, and has handled numerous IP enforcements and infringement cases, as well as patent and trademark opposition proceedings before the IPTO (Israeli Patent and Trademark Office). Omer specializes in disputes concerning ownership of patents and trademarks and invalidation thereof, in both local and cross-border disputes.
He has extensive experience in complex commercial litigation, mainly corporate law disputes and crises. He has gained extensive experience in handling matters of corporate control, shareholder disputes and conflicts resulting from corporate mergers, acquisition and investment transactions, and has specific expertise in handling such disputes in Hi-Tech and technology or IP based companies, in view of the unique challenges facing such corporations.
Omer has handled conflicts between competitors; dissolution of technological joint ventures and distribution of joint IP assets; matters concerning licensor-licensee relations; and rights of employee inventors and developers. He further assists Israeli entities involved in cross-border disputes and multi-jurisdiction litigation obtain legal counselling in foreign jurisdictions, dealing with complex private international law issues, and forming a worldwide strategy.
Omer’s practice further includes matters pertaining to the media, journalism and entertainment, counselling print media and broadcasters regarding use of content subject to copyright and performers’ rights, and providing pre-broadcast clearance concerning freedom of speech issues, privacy, defamation, journalism ethics, judicial gag orders and censorship.
Omer’s experience enables him to assist his clients in crisis management and preparation for anticipated litigation, as well as to counsel them on how to minimize their exposure and avoid potential litigation.
Prior to joining APM Omer was a partner with Carmel, Peled & Co., and prior to that a senior lawyer with S. Horowitz & Co.
He clerked with Hanan Melcer, currently presiding as deputy chief justice, and with Justice Esther Hayut, currently presiding as chief justice, of the Israeli Supreme Court.
